§ 30-753 <br /> <br />VICTORIA CODE <br /> <br />b. In accordance with such permit. <br />(b) Failure to obtain. Failure to obtain a per- <br />mit shall be cause to deny issuance of a building <br />permit, prohibit continuation of any construction <br />on the property, connection or extension of any <br />utilities on the property or on any adjacent streets, <br />issuance of a certificate of occupancy and to <br />require remedial action in accordance with the <br />tree replacement table to replace significant trees <br />lost or expected to be lost as a result of activity on <br />the site. <br /> (c) Form of application~ Application for a per- <br />mit for tree removal and replacement shall be <br />made in writing using the form provided by the <br />city. The application shall include: <br /> <br /> (1) The name and address of the person ap- <br /> plying for the permit. <br /> <br /> (2) The name, address and signed concur- <br /> rence from the owner of land. <br /> <br /> (3) A plan which includes the existing and <br /> proposed locations of buildings, roads, util- <br /> ities and easements, public parks and <br /> open spaces, lots and blocks, water bodies <br /> and wetlands, proposed building pads, <br /> equipment and material storage areas, <br /> the tree inventory, and tree replacement <br /> and tree protection. <br /> <br /> (4) The estimated period of time within which <br /> the tree replacement will be conducted. <br /> <br /> (5) Atopographic map of the land at a scale of <br /> one inch equals 50 feet (unless an alter- <br /> native scale is authorized) and showing <br /> ground elevation contours at two-foot in- <br /> tervals. The map shall show: <br /> <br /> a. The land and the abutting 150 feet <br /> as it exists prior to the proposed <br /> activity. <br /> <br /> b. The proposed ground elevation con- <br /> tours at two-foot intervals when grad- <br /> ing, filling or altering the site is <br /> completed. <br /> <br /> c. A regrading, drainage and planting <br /> plan, if appropriate for the land. <br /> · d. The location and size of all building <br /> pads, equipment and material stor- <br /> age areas. <br /> <br /> e. All significant trees to be protected <br /> and trees to be removed. <br /> f. Type and location of tree protection <br /> measures. <br /> <br /> (6) A statement relating to the proposed use <br /> of the land, including the type of building <br /> or structure situated thereon or contem- <br /> plated to be built thereon, and the loca- <br /> tion and size of bui]dlng pads. <br />(Ord. Tree inventory. <br /> <br /> The developer shall have a tree inventory pre- <br />pared by a certified registered land surveyor, <br />landscape architect or forester depicting: <br /> <br /> (1) The size, species, condition and location <br /> on the land of all significant trees. On <br /> large wooded sites, forest mensuration <br /> methods may be used to determine the <br /> total diameter inches of trees on the prop- <br /> erty. <br /> <br /> (2) Significant trees which will be lost due to <br /> the proposed activities. Significant trees <br /> shall be considered lost as a result of: <br /> <br /> a. Grade change, including grading or <br /> filling, whether temporary or perma- <br /> nent, affecting 55 percent or more of <br /> the tree's critical root zone. <br /> b. Utility construction (i.e., sewer, wa- <br /> ter, storm sewer, gas, electric, tele- <br /> phone, cable TV, fiber optics or sim- <br /> ilar facilities) resulting in the cutting <br /> of 45 percent or more of the tree's <br /> roots within the critical root zone. <br /> c. Mechanical injury to the t~mk of a <br /> significant tree causing loss of more <br /> than 40 percent of the circumference <br /> of any portion of the trunk bark. <br /> <br /> d. Compaction to a depth of six inches <br /> or more of 45 percent or more of the <br /> surface of the soil within a signifi- <br /> cant tree's critical root zone. <br /> <br /> (3) The location, number, type and size of <br /> replacement trees required to be replaced <br /> pursuant to this division. <br />(Ord.
