DRAFT <br /> <br />ORDINANCE NO. , FOURTH SERIES <br /> <br />AN ORDINANCE PERTAINING TO TREE PRESERVATION AND AMENDING <br />THE CITY CODE BY ADDING SECTION 11.63. <br /> <br />THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: <br /> <br /> Section I - The City Code is amended by adding a new section 11.63 to read: <br />SEC, 11,63 TREE PRESERVATION <br /> <br />Subd. 1. Findings and Purpose. The City Council finds that it is in the best interest of the City <br />to protect, preserve, and enhance the natural environment of the community and to encourage a <br />resourceful and prudent approach to the development and alteration of wooded areas. In the <br />interest of achieving these objectives, the City Council has established these comprehensive tree <br />preservation regulations to promote the furtherance of the following objectives: <br /> <br />A. Protection and preservation of the environment and natural beauty of the city; <br /> <br />Bo <br /> <br />Assurance of orderly development within wooded areas to minimize tree and <br />habitat loss; <br /> <br />The evaluation of specific sites as to the development's impact on trees and <br />wooded areas; <br /> <br />Establishment of minimal standards for tree preservation and the mitigation of <br />environmental impacts resulting from tree removal; <br /> <br />Provision of incentives for creative land use and environmentally compatible site <br />design that preserve trees and minimize tree removal and clear-cutting during <br />development; and <br /> <br />Fo <br /> <br />Enforcement of tree preservation standards to promote and protect the public <br />health, safety and welfare of the community. <br /> <br />Subd. 2. Definitions. For purposes of this Section the following terms have the meanings given <br />to them: <br /> <br />Applicant means any person or entity, which is required to submit and implement <br />an approved tree preservation plan under this section. <br /> <br />Builder means any person or entity to which a building permit is issued for the <br />construction of a single-family residence. <br /> <br />Caliper inch means the diameter of replacement trees measured at a height of <br />one foot above the ground level. <br /> <br />Construction area means any area in which movement of earth, alteration in <br />topography, soil compaction, disruption of vegetation, change in soil chemistry, <br />or any other change in the natural character of the land occurs as a result of the <br />site preparation, grading, building construction or any other construction activity. <br /> <br /> <br />
