No CU 08-16 -Public Reviewed by <br />Hearing <br />Action Requested <br />Staff and the Planning Commission recommend approval of the interim use permit request, as illustrated <br />on drawings dated June 2, 2008, with the following conditions: <br />1. All MnDOT comments outlined in the letter dated June 25, 2008 shall be addressed. <br />2. Provision of a spectator safety plan to be approved by the Elk River Fire Department. <br />3. Provision and approval of an on-site traffic/ distribution plan that demonstrates: <br />Logical on-site distribution of participants, spectators, and public safety <br />Adequate on-site stacking for admission and egress <br />Adequate off-site stacking for access and egress without impacting US <br />Highway 169. <br />4. As an interim use permit is not a building permit, the applicant shall apply for all <br />required permits. <br />5. The development shall meet all applicable fire codes. <br />6. Hours of operation shall be limited to 7 a.m. to 7 p.m., Monday through Friday; 8 a.m. to <br />4:30 p.m. Saturday and Sunday <br />7. No overnight parking in spectator lot. <br />Summary <br />The Planning Commission held a public hearing to review the proposed interim use permit on July 8, <br />2008. This is the first project in the Commercial Reserve Transitional (CRT) area. The interim use is <br />reviewed for not only compliance with the typical conditional use permit concerns, but also the intent of <br />the future use of the district. Any new development in the CRT area has the potential to alter or impact <br />the planning or final development efforts. <br />Plannin$ Commission Discussion <br />The Planning Commission had concerns with traffic on and off site, security, noise generation. At the <br />meeting, the Commission learned that there is a variety of events, from single day practice sessions to <br />three-day competition events. Traffic leaving the events is typically staggered throughout the day so there <br />is no one time rush.
