RESOLUTION 08- <br />A RESOLUTION OF THE CITY OF ELK RIVER <br />A RESOLUTION EXTENDING THE MORATORIUM ON THE ISSUANCE <br />OR TRANSFER OF LICENSES FOR THE SALE OF TOBACCO PRODUCTS <br />WHEREAS, The Ciry Council of the City of Elk River imposed a moratorium on the <br />issuance or transfer of licenses for the sale of tobacco products for establishments where the <br />sale of tobacco products is the primary business of the establishment; and <br />WHEREAS, The purpose of the moratorium was to have city staff research and prepare <br />amendments to the city's ordinance requirements for the issuance of licenses for tobacco <br />sales; and <br />WHEREAS, City staff needs additional time to prepare an ordinance amendment for City <br />Council consideration. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ciry of Elk <br />River, Minnesota: <br />1. That the moratorium on tobacco licensing shall be extended to and including July 29, <br />2008. <br />2. That during the moratorium period, the city shall not issue any new license for the <br />sale of tobacco, nor approve any transfer of any existing license to a new licensee, for <br />any establishment where the sale of tobacco products is the primary business of the <br />establishment. <br />3.
