Memo to City Council/Meshich Page 2 <br />February 20, 1996 <br /> <br />The City of Elk River currently requires an annual kennel permit as well as a <br />conditional use permit for kennels. The definition used to define a kennel for a <br />kennel permit is different from the one used to define a kennel for zoning <br />purposes. The definition used for the kennel permit includes all kennels, both <br />personal and commercial; whereas, the zoning definition refers to kennels <br />operated for compensation or sale. The granting of this conditional use permit <br />would allow the applicant, even though they are not proposing to now, or future <br />owners of the property to operate a commercial kennel. <br /> <br />Planning Commission Meeting <br /> <br />At the January 23, 1996 Planning Commission meeting, the Commission <br />recommended approval of a conditional use permit to allow a kennel. At the <br />public hearing the neighbor to the north expressed concern regarding the <br />visibility of the kennel from her property. Since the kennel is lower than her <br />property, the kennels will be seen from her house and she felt it would lower the <br />value of her house. The Commission discussed the issue of visibility as well as <br />methods to keep this from becoming a commercial kennel. In order to reduce the <br />visibility from the neighbor's property, the Commission recommended that the <br />kennel be screened with some type of vegetative screening and to limit the <br />possibility of this becoming a commercial kennel, they recommended to not allow <br />outside boarding of dogs not owned by the owner of the home. <br /> <br />Recommendation <br /> <br />The Planning Commission recommended approval of a conditional use permit <br />request to allow a kennel at 11401 205th Avenue NW with the following <br />conditions: <br /> <br />The applicant shall comply with Section 502.36 and Section 502.38 <br />of the Elk River City Ordinance which regulate kennel permits <br />and kennel conditions. <br /> <br />Not to allow outside boarding of dogs outside of those owned by <br />the owner of the home. <br /> <br />3.
