Case File: CU 08-16 <br />Page 3 <br />Conditional Use Permit <br />F.Ik River Motocross <br />Interim Use Pernut <br />The issuance of an Interim Use Permit can be ordered only if the use at the proposed location: <br />7. iYlill not endanger, injure or detrimentally ajfect the use and enjoyment of other property in the immediate <br />vicznity or the public health, safety, morale', comfort, convenience orgeneral welfare of the neighborhood or the <br />cry. <br />Staff has raised concerns with potential for noise. Recent area mining operations <br />have been limited to 7-7 M-F 8:00 to 4:30 on Saturday. The proposal indicates the <br />majority of activities would follow this time frame. However, the applicant has <br />indicated that there may be some night events. <br />2. mill be consistent with the comprehensive plan. <br />The proposed use is consistent with the Comprehensive Plan. <br />3. Will not impede the normal and orderly development and improvement of surrounding vacant property. <br />It is unclear if this project will impede orderly development; however, the IUP lasting <br />5 years allows the City, and inform the property owner of the ,intent to redevelop the <br />property in the future. In 5 years, it is unlikely that the market will reach the <br />surrounding properties to the point where the proposed use impedes growth. <br />4. Will be served adequately by and will not adversely affect essential public facilities and services including <br />streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and <br />will not, in particular, create tra~c congestion or interference with tra~c on adjacent and neighboring public <br />thoroughfares. <br />It is unclear if the existing infrastructure is sufficient to support the peak use. The <br />site will not impose on the city's water or sewer system. <br />S. lY/ill not involve uses, activities, processes, materials, equipment and conditions of operation that will be <br />detrimental to any persons or property because of excessive tra~c, noise, smoke, fumes, glare, odors, dust or <br />vibrations. <br />Noise issues have been discussed in #1 above. The Council could limit the hours if <br />deemed necessary.
