of <br />fiver <br />MEMORANDUM <br />TO: Lori Johnson, City Administrator <br />FROM: Terry Maurer, Public Works Director <br />DATE: June 11, 2008 <br />SUBJECT: Burandt Easement for 193~d Avenue Corridor <br />After last Monday evening's discussion, I have had an opportunity this week to talk face to <br />face with Mr. Burandt about the Council direction. It is my opinion that it will be difficult to <br />negotiate a satisfactory scenario where the Burandts will execute the necessary easement in a <br />timely fashion. Therefore, I have reviewed the preliminary plans for 193Ld Avenue to look at <br />other possibilities. <br />As you axe aware, the plans currently include a bituminous pathway on the south side <br />(Burandt side) of the roadway. This bituminous pathway starts at CSAH 13 and goes to <br />Xavier Street in the Woods at Hillside area. At that point, there will be no pedestrian facility <br />on the south side of the existing 193`d Avenue; therefore, pedestrians will need to cross to <br />the north side where there is an existing concrete sidewalk. If the city were to eliminate the <br />bituminous pathway from the south side of 193`d Avenue between Tyler Street to Xavier <br />Street and add a small portion of retaining wall approximately 100-125 feet long and up to 6 <br />feet high, the roadway could be built without any easements from the Burandts. If no <br />easements from the Burandts are needed, the city could also remove excess chain link <br />fencing that was added at the Burandts request as we were working with them to mitigate <br />any impacts the roadway would have on their property. There would still need to be a small <br />section of chain link fence as the roadway crosses the wetland, utilizing retaining walls that <br />need protection facilities along the top. <br />I have done a quick analysis of the potential cost of adding a retaining wall to the project <br />versus removing the pathway mentioned above and a portion of the chain link fence. From <br />a financial standpoint, the affect on the total cost of the project would be neutral. The <br />pathway could always be added at a latex date from Tyler Street to Xavier Street. <br />One other question should be asked of the Council if they want to pursue this course of <br />action; should we eliminate the bituminous trail in its entirety including the section between <br />CSAH 13 and Tyler Street. <br />
