COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION <br />CARRIED 5-0. <br /> <br />Preliminary Plat for Rick Lund, Public Hearin.q, Case No. P 95-8 <br /> <br />City Planner Steven Ach indicted that Rick Lund is requesting approval of a <br />preliminary plat to subdivide approximately 23 acres into 44 single family lots. The <br />property is located along the east side of County Road No. 1 and the 196th Street <br />alignment. Steven Ach reviewed the staff report on this issue. He indicated that <br />the Park and Recreation Commission has recommended a cash dedication be <br />provided based on the number of lots. He stated that the Park and Recreation <br />Commission has also expressed the need to expand the road width from County <br />Road No. 1 to a point further east, to accommodate an on-road trail system <br />connecting Meadowvale Heights and the city trail. <br /> <br />Steven Ach stated that the Planning Commission reviewed the preliminary plat <br />and recommended approval. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Jim Nord, 19806 Elk Lake Road indicated he owned the adjacent property from <br />the plat. Mr. Nord also expressed a concern of constructing the trail through his <br />property prior to his development. <br /> <br />Steve Johnston, project engineer indicated he was in agreement with all of the <br />preliminary plat conditions recommended by city staff. <br /> <br />There being no further comments, Mayor Duitsman closed the public hearing. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE PRELIMINARY PLAT REQUEST <br />BY RICK LUND FOR NORDIC WOODS, CASE NO. P95-8 BASED ON THE FOLLOWING <br />CONDITIONS: <br /> <br />THE PLAT BE REVISED TO MINIMIZE IMPACT TO THE DNR STREAM AND THE <br />AMOUNT OF A SETBACK VARIANCE FOR THE EXISTING HOME. <br /> <br />THE EXISTING HOME BE REMODELED TO HAVE A COMPATIBLE APPEARANCE <br />WITH THE NEW HOMES WITHIN THE DEVELOPMENT. <br /> <br />A DEVELOPER'S AGREEMENT BE PREPARED OUTLINING THE TERMS AND <br />CONDITIONS FOR PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS. <br /> <br />COMMENTS OUTLINED IN THE CITY ENGINEER'S MEMO DATED 2/19/96, BE <br />ADDRESSED AND INCORPORATED INTO REVISED PLAT. <br /> <br />RECOMMENDATIONS FROM THE PARK AND RECREATION COMMISSION BE <br />INCORPORATED INTO APPROVAL FOR PRELIMINARY PLAT. <br /> <br />WATER AVAILABILITY CHARGE IN THE AMOUNT OF $300 PER LOT BE PAID TO <br />ELK RIVER UTILITIES PRIOR TO RELEASING THE FINAL PLAT FOR RECORDING. <br /> <br /> <br />
