I note that your <br />application references your 2004 conditional use permit application for the application <br />materials, and you noted that nothing has changed in terms of proposal from the original <br />request. <br />Please confirm that you agree to all conditions outlined in the attached 2004 Conditional Use <br />Permit, notably Section 10 (traffic), Section 11 (dust control), Section 12 (Hours of <br />Operation), Section 17 (Groundwater protection measures). This 2004 Conditional use <br />Permit will be a starting point for review by you and the City, and the City Council may <br />make any changes it deems necessary. <br />One issue remaining unresolved from the 2004 Conditional use Permit is satisfaction of <br />wetland mitigation requirements. The original Conditional Use Permit included a provision <br />to purchase wetland credits from Schuer, plus provision of a letter of credit for the wetland <br />restoration. <br />Please verify the acres of wetland disrupted, (from 2004) and the amount of wetlands to be <br />mitigated on site. Please provide a written estimate of costs to perform this work once <br />mining has been completed (including mobilization, plant materials/ seed).
