Memo to Mayor & City Council/P 01-06 <br />Mamh 19, 2001 <br />Page 5 <br /> <br />The Planning Commission voted unanimously to recommend approval of the <br />land use and zone changes to the City Council. They voted 5-2 to recommend <br />approval of the preliminary plat and the conditional use permit to the City Council. <br /> <br />Recommendation <br /> <br />Staff and the Planning Commission recommend that the City Council approve the <br />land use applications requested by the appiicant as follows: <br /> <br />Land Use Amendment: <br /> <br />Approve the attached resolution amending the land use from HB, Highway <br />Business, to MR, Medium Density Residential and HB, Highway Business in <br />order to create a lower impact residential transition zone from the Mississippi <br />River. <br /> <br />Zone Change <br /> <br />Approve the attached ordinance changing the zoning from C3, Highway <br />Commercial to PUD, Planned Unit Development with the following findings of <br />fact: <br /> <br />1. THAT THE REZONING IS CONSISTENT WITH THE CITY'S <br /> COMPREHENSIVE PLAN AND ZONING ORDINANCE. <br /> <br />2. THAT THE REZONING WILL NOT CREATE ADVERSE IMPACTS TO <br /> ADJACENT USES. <br /> <br />THAT THE REZONING WILL ALLOW A MIXED USE (COMMERCIAL AND <br />RESIDENTIAL) DEVELOPMENT THAT CREATES A LOW-IMPACT <br />RESIDENTIAL TRANSITION ZONE ADJACENT TO THE MISSISSIPPI <br />RIVER AND EXISTING RESIDENTIAL PROPERTIES. <br /> <br />Preliminary Plat and Conditional Use Permit <br /> <br />Approve the preliminary plat and conditional use permit for eight commercial lots <br />and 20 twinhome townhome lots with the following conditions: <br /> <br />1. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED. <br /> <br />ALL COMMENTS AND CONDITIONS INCLUDED IN THE BUILDING <br />AND ZONING ADMINISTRATOR'S MEMO OF FEBRUARY 27, 2001 <br />BE INCLUDED AND ADDRESSED. <br /> <br />YALE STREET BE CONNECTED TO ZANE STREET ON THE <br />NORTH AND 170TM AVENUE ON THE SOUTH. <br /> <br />S:\PLANNING\MICHMC\CCREPRTS\P01-O6.DOC <br /> <br /> <br />
