City Council Minutes Page 11 <br />February 20, 2001 <br /> <br /> owner and agreed to establish a no-cut zone at the rear of the homeowner's <br /> property. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br />Jim Brown, Dynamics Design and Land Company, gave on overview of the layout <br />of Ridges of Rice Lake. He described the entrance house and the two kiosks. Mr. <br />Brown stated that he would like to be able to have 25-foot driveway setbacks. <br /> <br />Mayor Klinzing closed the public hearing. <br /> <br />Councilmember Kuester questioned the lighting. Mr. Brown stated that an <br />architectural control committee would approve lighting. The kiosks would have <br />Iow lighting attached to them. <br /> <br />Councilmember Motin questioned whether vehicle access would be allowed on <br />221st Avenue on the south side of Outlot B. Ms. McPherson stated that this access <br />would become an entrance for an area-wide park. Councilmember Motin stated <br />that he would like Outlot H eliminated to be made part of the street right-of-way. <br /> <br />Councilmember Motin also questioned whether density bonuses were a wise <br />concept. Councilmember Motin stated that developers of these types of cluster <br />developments are dedicating the wetland parcels as open space when normally <br />they would be open space as they are unbuildable. Councilmember Motin <br />questioned whether it was right that developers don't have to pay park <br />dedication fees. <br /> <br />Mayor Klinzing stated that having the open space protected as one large parcel <br />by a homeowners association was more preferable than having 10 acre <br />properties that each homeowner can do anything they want and not care about <br />protecting the open space. <br /> <br />Councilmember Tveite questioned the responsibility of septic and well monitoring. <br />City Engineer Terry Maurer stated that Outlot R is large enough to support a <br />community septic and would be monitored as required by law and the <br />homeowner's agreement. <br /> <br />Councilmember Tveite stated that the cul-de-sacs should not be extended past <br />the ordinance requirements. <br /> <br />Councilmember Kuester questioned who would be responsible for paving 221st <br />Avenue. City Engineer Terry Maurer stated that a condition should be added to <br />the preliminary plat stating that a fair share contribution to pave 221st Avenue be <br />agreed to by the developer and approved by Council before final plat approval. <br /> <br />Marly Glines, Dynamics Design and Land Company, stated that he was willing to <br />pay a portion of the paving costs. Mr. Glines noted that the septic would be <br />pumped and cleaned once a year. <br /> <br />Councilmember Kuester stated that she favored the 25-foot driveway setback in <br />order to preserve trees and would like it added as a condition, <br /> <br /> <br />
