Memoto Mayor & Ci~ CounciFAS 01-01 <br />Janua~ 16,2001 <br />Page 2 <br /> <br />Located on the subject property is a single family dwelling of 24'x36' and a shed <br />of 56'x68'. A 240' Northern States Power utility easement crosses the parcels <br />adjacent to County Road No. 33. The subject property is high and, based on <br />aerial photo interpretation, appears to have been farmed in row crops on a <br />regular basis. <br /> <br />The proposed lots meet the dimensional requirements for lot width and area for <br />the Rla, Single Family Zoning District. <br /> <br />County Access Requirements <br /> <br />Sherburne County Public Works has reviewed the administrative subdivision and <br />has indicated that the proposed 50 feet of right-of-way dedication will meet the <br />County requirements. This right-of-way will need to be granted in fee title to <br />Sherburne County. They have also required, in their letter, that Parcels A and B <br />share a single driveway. Staff would recommend that cross-access easements <br />be recorded against Parcels A and B, acknowledging a shared driveway onto <br />County Road No. 33. <br /> <br />The City Engineer has reviewed the administrative subdivision and has observed <br />that the existing home does not comply with the setback requirements and <br />therefore, would be nonconforming. To correct this situation, a variance would <br />need to be granted or the property owner would need to acknowledge that if the <br />home were to be damaged beyond 50 percent of its value, it could not be rebuilt <br />in its current location without a variance. <br /> <br />Park Dedication/Storm Water Manaqement Fees <br /> <br />The Park and Recreation Commission, at its January 10, 2001 meeting, <br />recommended that cash dedication be accepted for this subdivision. <br /> <br />Surface water management fees at the rural rate will be required to be paid. <br /> <br />Recommendation <br /> <br />Staff recommends that the City Council approve the administrative subdivision <br />request AS 01-01, to create three parcels in the Rla Single Family Residential <br />zoning district, with the following conditions: <br /> <br />1. The dedication of 50 feet of right-of-way shall be completed in fee title. <br />2. The applicant shall pay Park Dedication fees for two parcels. <br />3. The applicant shall pay Surface Water Management fees for two parcels. <br />4.
