THE <br />AMENDMENT CARRIED 5-0. <br /> <br />THE MOTION AS AMENDED CARRIED 5-0. <br /> <br />6.8. <br /> <br />The Council took a ten minute break at 8:50 p.m. <br /> <br />Request by City. of Elk River for Easement Vacation (portion of 179th Avenue), Public <br />Hearing- Case No. EV 02-03 <br /> <br />Director of Planning Michele McPherson submitted the staff report. Ms. McPherson stated <br />that the City is asked to vacate a portion of 179th Avenue right-of-way lying east of Twin <br />Lakes Road and between Outlots A and B of Elk River Crossing. She stated that this right- <br />of-way would become part of a land exchange with D.R. Horton. <br /> <br />Mayor I~dinzing opened the public hearing. There being no one to speak to this issue, Mayor <br />ICdinzing closed the public hearing. <br /> <br />COUNCILMEMBER DIETZ MOVED TO APPROVE RESOLUTION 02-28 <br />VACATING A PORTION OF THE 179TM AVENUE RIGHT-OF-WAY WITH <br />THE FOLLOWING CONDITION: <br /> <br />AN EASEMENT FOR EMERGENCY ACCESS OVER THIS AREA <br />MUST BE PROVIDED ON THE FINAL PLAT OF TROTT BROOK <br />FARMS SOUTH. <br /> <br />COUNCILMEMBER KUESTER SECONDED THE MOTION. THE MOTION <br />CARRIED 5-0. <br /> <br />6.9. <br /> <br />Consider Land Exchange with D.R. Horton <br /> <br />Director of Planning Michele McPherson submitted the staff report. Ms. McPherson stated <br />that D.R.
