THE MOTION CARRIED $-0. <br /> <br />Page 5 <br /> <br />6.2. Comprehensive Plan Update <br /> <br />Director of Planning Michele McPherson updated the Council on activities of the <br />Comprehensive Plan Task Force. <br /> <br />Councilmember Tveite stated that he is disappointed in the low public turnout at these <br />meetings. <br /> <br />Task Force member Ron Haup questioned why the Planning Commission applicants (here <br />for the last agenda item) have not appeared at any Comprehensive Plan Task Force <br />meetings. He indicated that a Comprehensive Plan question would have been good for the <br />interviews. He also stated that it is good to have the Comprehensive Plan information on <br />the city's website. <br /> <br />6.3. Consider Wetland Conservation Act Decision - Birchview, WCA 02-11 <br /> <br />Staff report submitted by Building and Zoning Administrator Steve Rohlf with Director of <br />Planning Michele McPherson presenting. Ms. McPherson stated that the developer for <br />Birchview is proposing to fill 8,050 square feet of Type 3 wetland to accommodate a road. <br />She discussed the findings and recommendations of the Technical Evaluation Panel. <br /> <br />COUNCILMEMBER KUESTER MOVED TO APPROVE THE FILLING AND <br />MITIGATION PLAN FOR BIRCHVIEW WITH THE FOLLOWING <br />CONDITIONS: <br /> <br />A RESTRICTIVE COVENANT AND DRAINAGE AND UTILITY <br />EASEMENT BE RECORED OVER THE MITIGATION AND BUFFER <br />AREAS. <br /> <br />o <br /> <br />THE DEVELOPER'S AGREEMENT FOR THE PROJECT INCLUDES <br />LANGUAGE THAT PLACES THE RESPONSIBILITY FOR THE <br />SUCCESS OF THE WETLAND MITIGATION ON THE DEVELOPER. <br /> <br />° <br /> <br />THE LETTER OF CREDIT, WHICH COVERS THE PUBLIC <br />IMPROVEMENTS ASSOCIATED WITH THE PROJECT, ALSO <br />INCLUDES THE COST OF THE MTIGATION WORK. <br /> <br />° <br /> <br />THE DEVELOPER SUBMIT A WRITTEN MONITORING REPORT <br />ON THE REPLACEMENT WETLANDS ONE YEAR AFTER THIS <br />MITIGATION WORK IS COMPLETED AND THAT THIS REPORT BE <br />APPROVED BY CITY STAFF PRIOR TO THE RELEASE OF THE <br />LETTER OF CREDIT. <br /> <br />° <br /> <br />THE SWALE FOR RUN OFF FROM THE EASTERN PORTION OF <br />THE ROAD SHALL BE BUILT WITH A DIKE ACROSS IT (MIN. ONE <br />FOOT HIGH) TO TRAP SEDIMENT PRIOR TO DISCHARGING INTO <br />THE NATURAL WETLAND ON THE PROPERTY AND/OR A <br />PORTION OF IT IS DEEPENED TO SERVE THE SAME PURPOSE. A <br /> <br /> <br />
