I <br /> <br />Request <br /> <br />The Council is requested to adopt an ordinance which repeals the existing code and enacts a <br />new code for the City of Elk River. <br /> <br />Process <br /> <br />The recodification of the City Code entailed a legal review of the entire code by an attorney <br />from Municipal Code Corporation OVICC). MCC is the company the City hired to recodify <br />the code. The review identified conflicts, inconsistencies and obsolete provisions in <br />conjunction with state statutes, as well as conflicts within the code itself. This process also <br />involved review of the code by the City's Attorney and all departments of the City. As you <br />will see, the end result is a city code that has been reorganized and renumbered to make it <br />much more user friendly, not to mention the fact that it has a more professional appearance. <br /> <br />Attached is a memorandum from the Senior Code Attorney at Municipal Code Corporation. <br />This memorandum summarizes the changes that have been made to the City Code. All <br />changes have been reviewed by the City's Attorney and by Department Heads. <br /> <br />Zoning Ordinance <br /> <br />State Statute requires a public hearing for all text amendments to the Zoning Code, the <br />Planning Commission and City Council are required to conduct a public hearing prior to <br />adoption of the recodified code. <br /> <br />The changes between Chapter 900 "Zoning" and Chapter 30 are summarized below: <br /> <br /> <br />
