THE REVISED DRAINAGE AND UTILITY EASEMENT FOR LOT <br /> 3, BLOCK 1, WHITETAIL RIDGE BE RECORDED WITH <br /> SHERBURNE COUNTY. <br /> <br />COUNCILMEMBER TVEITE SECONDED THE MOTION. THE MOTION <br />CARRIED 5-O. <br /> <br />6.3. <br /> <br />Request by Bob and Tern Bostrom for Conditional Use Permit to Create a Pond, Public <br /> <br />Hearing - Case No. CU 02-25 <br /> <br />Staff report submitted by Building and Zoning Administrator Steve Rohlf with Director of <br />Planning Michele McPherson presenting. Ms. McPherson stated that the applicant is <br />proposing to excavate a Type 2 wet/and in order to create some open water for wilctlife <br />habitat and improved aesthetics. <br /> <br />Mayor Klinzing opened the public hearing. There being no one to speak to this issue, Mayor <br />IqJinzing closed the public hearing. <br /> <br />COUNCILMEMBER DIETZ MOVED TO APPROVE THE WETLAND <br />EXCAVATION TO CREATE A POND WITH THE FOLLOWING <br />CONDITIONS: <br /> <br />1. STAFF'S DECISION ON THE WCA IS NOT OVERTURNED ON AN <br /> APPEAL. <br /> <br />2. FOR SAFETY REASONS, A MAXIMUM OF 4 TO 1 SLOPES ARE <br /> MAINTAINED IN THE WETLAND. <br /> <br />ALL SPOILS REMOVED FROM THE WETLAND ARE DEPOSITED <br />ON UPLAND AREAS OF MS. BOSTROM'S PROPERTY AND A <br />MINIMUM OF 66 FEET FROM THE COUNTY DITCH. <br /> <br />ALTHOUGH THE PROPOSED POND WILL BE IN A DRAINAGE <br />AND UTILITY EASEMENT, THE MAINTENANCE OF IT IS SOLELY <br />THE RESPONSIBILITY OF THE PETITIONER. <br /> <br />COUNCILMEMBER KUESTER SECONDED THE MOTION. THE MOTION <br />CARRIED 5-0. <br /> <br />6.4. <br /> <br />Request by Daniel O'Bresky for Conditional Use Permit for Subway Restaurant ,(Elk River <br />Crossing 4th), Public Hearing- Case No. CU 02-24 <br /> <br />Staff report submitted by Planner Chris Leeseberg. Mr. Leeseberg stated that the applicant is <br />requesting a conditional use permit to build a Subway Restaurant. He discussed design <br />standards, landscaping, parking, traffic circulation, and Planning Commission action. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br />Daniel O'Bresky, applicant - Stated that the preliminary site plan had an error with the <br />island and median by the driveway entrance. He stated that the island and median would be <br />three foot and not five foot as indicated. <br /> <br /> <br />
