Ms. Cartney reviewed the proposed changes to <br />the ordinance amendment, including a statement addressing advertisement of an event for <br />more than 30 days, and approval for signs by the City Administrator or designee. <br />Chair Stevens opened the public hearing. There being no public comment, Chair Stevens <br />closed the public hearing. <br />Commissioner Westgaard stated that the added language helps to clarify the issue. <br />MOTION BY COMMISSIONER WESTGARD AND SECONDED BY <br />COMMISSIONER LEMKE TO RECOMMEND APPROVAL OF THE <br />ORDINANCE AMENDMENT RELATING TO SIGNS ON PUBLIC PROPERTY <br />AS OUTLINED IN THE STAFF REPORT, CASE NO. OA 07-09. MOTION <br />CARRIED 6-0. <br />5.6. Request by Citv of Elk River for an Ordinance Amendment to Section 30-1562 of the Code <br />of Ordinances Relating To Commercial Reserve, Public Hearing -Case No OA 07-13 <br />Mr. Barnhart reviewed the proposed changes to the Commercial Reserve Transitional (CRT) <br />zoning district relating to interim uses. The changes included limiting interim uses to 5 <br />years, requirement for an escrow, and outdoor storage. <br />Chair Stevens opened the public hearing. There being no public comment, Chair Stevens <br />closed the public hearing. <br />Commissioner Lemke asked if Item (14) of the amendment pertains to existing outdoor <br />storage in the CRT. Mr. Barnhart stated yes. Commissioner Westgaard asked if the outdoor <br />storage applied to businesses and farms with outdoor storage. Mr. Barnhart stated no, that <br />the intent is not to apply to general outdoor storage, but permanent intentional storage <br />facilities. Commissioner Westgaard asked if it would apply to a business having 5,000 square <br />feet of office space and 10,000 square feet of storage. Mr. Barnhart stated yes, it would <br />apply. He explained that the city recognizes there are uses which are appropriate in this <br />district now, but may not be appropriate in the future. Chair Stevens stated that the intent is <br />not to have non-business related storage. <br />Mr. Barnhart stated that the intent of the amendment is to balance the interests of the city <br />and the needs of the property owners in this zoning district. <br />Commissioner Lemke asked if a property owner could request an extension. Mr. Barnhart <br />stated that applicants for interim uses will be advised that an extension may be permitted, <br />but not to expect it. <br />Chair Stevens stated that he felt that the property owners with concerns who attended the <br />City Council meeting on this matter in November, left with the understanding that the <br />rezoning was a planning tool and no immediate changes would be made. <br />Commissioner Staul stated that he felt the amendment was appropriate and he had no <br />problem with it as written. <br />MOTION BY COMMISSIONER WESTGAARD AND SECONDED BY <br />COMMISSIONER LEMKE TO RECOMMEND APPROVAL OF THE REQUEST <br />BY THE CITY OF ELK RIVER FOR AN ORDINANCE AMENDMENT <br />
