<br />written confirmation to the code official before a certificate of
<br />occupancy is issued that the performance-based design has
<br />been properly implemented, the operation or use of the build-
<br />ing iswithinthe limitations of the design, and adequate controls
<br />are in place to maintain compliance with the conditions of the
<br />design throughout the life of the building.
<br />na Subp. 15. Tests. If there is insufficient evidence of compliance
<br />M with the code, or evidence that a material or method does not
<br />M conform to the requirements of the code, or in order to sub-
<br />M stantiate claims for alternative materials or methods, the build-
<br />M ing official shall have the authority to require tests as evidence
<br />M of compliance to be made at no expense to the municipality.
<br />M Test methods shall be as specified in the code or by other recog-
<br />M sized test standards. In the absence of recognized and accepted
<br />M testmethods, the building official shall approve the testingpro-
<br />M cedures. Tests shall be performed by an approved agency. Re-
<br />M ports of the tests shall be retained by the building official.

<br />M PERMITS
<br />Subpart 1. Required. An owner or authorized agent who in-
<br />tends to construct, enlazge, alter, repair, move, demolish, or
<br />change the occupancy of a building or structure; erect, install,
<br />enlarge, alter, repair, remove, convert, or replace any gas, me-
<br />chanical, electrical, plumbing system, or other equipment, the
<br />installation of which is regulated by the code; or cause any such
<br />work to be done, shall first make application to the building of-
<br />ficial and obtain the required permit.
<br />Subp. 2. Annual permit. In lieu of an individual permit for
<br />each alteration to an already approved building or electrical,
<br />gas, mechanical, or plumbing installation, the building official
<br />may issue an annual permit upon application for the permit to
<br />any person, firm, or corporation regularly employing one or
<br />more qualified trade persons in the building, structure, or on the
<br />premises owned or operated by the applicant for the permit.
<br />Subp. 3. Annual permit records. The person to whom an
<br />annual permit is issued shall keep a detailed record of alter-
<br />ationsmade under the annual permit. The building official shall
<br />have access to the records at all times or the records shall be
<br />filed with the building official as designated.
<br />Subp. 4. Work exempt from permit. Exemptions from permit
<br />requirements of the code do not authorize work to be done in
<br />any manner in violation of the code or any other laws or ordi-
<br />nances of this jurisdiction. Permits shall not be required for the
<br />following:
<br />A. Building:
<br />(1) one-story detached accessory structures, used as
<br />tool and storage sheds, playhouses, .and similar
<br />uses, provided the floor area does not exceed 120
<br />square feet (11.15 mm2);
<br />(2) fences not over six feet (1829 mm) high;
<br />(3) oil demcks;
<br />(4) retaining walls that are not over four feet (1219
<br />mm) in height measured from the bottom of
<br />the footing to the top of the wall, unless supporting
<br />

<br />a surcharge or impounding Class I, II, or III-A
<br />liquids;
<br />(5) water tanks supported directly upon grade if the ca-
<br />pacity does not exceed 5,000 gallons (18927 L) and
<br />the ratio of height to diameter or width does not ex-
<br />ceed 2 to 1;
<br />(6) sidewalks and driveways that are not part of an ac-
<br />cessible route;
<br />(7) decks and platforms not more than 30 inches (762
<br />mm) above adjacent grade and not attached to a
<br />structure with frost footings and which is not part of
<br />an accessible route;
<br />(8) Painting, papering, tiling, carpeting, cabinets,
<br /> countertops, and similar finish work;
<br />(9) temporary motion picture, television, and theater
<br /> stage sets and scenery;
<br />(10) prefabricated swimming pools accessory to
<br /> dwelling units constructed to the provisions of the
<br /> International Residential Code or R-3 occupancies
<br /> constructed to the provisions of the International
<br /> Building Code, which are 24 inches (610 mm)
<br /> or less in depth, do not exceed 5,000 gallons
<br /> (19 000 L) and are instaIIed entirely above ground;
<br />(11) window awnings supported by an exterior wall of
<br /> Group R-3, and Group U occupancies;
<br />(12) movable cases, counters, and partitions not over
<br /> five feet, nine inches (1753 mm) in height; and
<br />(13) agricultural buildings as defined in Minnesota Stat-
<br /> utes, section 16B.60, subdivision 5.
<br />Unless otherwise exempted, plumbing, electrical, and me-
<br />chanical permits are required for subitems (1) to (13).
<br />B. Gas:
<br />(1) portable heating, cooking, or clothes drying ap-
<br />pliances; and
<br />(2) replacement of any minor part that does not alter ap-
<br />proval of equipment or make the equipment unsafe.
<br />C. Mechanical:
<br />(1) portable heating appliances;
<br />(2) portable ventilation appliances and equipment;
<br />(3) portable cooling units;
<br />(4) steam, hot, or chilled water piping within any heating
<br />or cooling equipment regulated by this code;
<br />(5) replacement of any part that does not alter approval
<br />of equipment. or make the equipment unsafe;
<br />(6) portable evaporative coolers; and
<br />(7) self-contained refrigeration systems containing ten
<br />- pounds (4.5 kg) or less of refrigerant or that are actu-
<br />ated bymotors of one horsepower (0.75 kV~ or less.
<br />D. Plumbing: the clearing of stoppages, provided the work
<br />does not involve or require the replacement or rearrangement
<br />of valves, pipes, or fixtures.
<br />E. Electrical: an electrical permit is not required if work is
<br />inspected by the State Board of Electricity or is exempt from
<br />inspection under Minnesota Statutes, section 326.244.Obtain-
<br />ing a permitfrom the Board of Electricity does not exempt the
<br />work from other Minnesota State Building Code requirements
<br />relating to electrical equipment, its location, or its perfor-
<br />mance.
