Planning Commission / CU 06-08 <br />May 9, 2006 <br />Page 2 <br />Attachments <br />• Cover Sheet <br />• Location Map <br />Memo from Environmental Administrator <br />Applicants Narrative and Attachments <br />Overview <br />In December of 2004, the City Council approved an Ordinance Amendment which <br />increased the number of agricultural animals, to no more than twice currently allowed, <br />provided there is an approved manure management plan following the Minnesota Pollution <br />Control Agency Technical Guidelines for Manure Management and Applications and a <br />Conditional Use Permit (CUP). <br />The applicant is requesting a CUP to have 15 horses on a 10-acre site. They axe proposing <br />an 8-acre pasture area on the western 2/3 of the property. This area could allow fox up to <br />16 horses with a CUP. There is a one acre manure management site proposed to be located <br />in the northeast portion of the site with additional land area within the 8-acre pasture area. <br />They have put together a manure management plan which does meet Minnesota Pollution <br />Control Agency Technical Guidelines for Manure Management and Applications. <br />The applicant's narrative (with this CUP) discusses the desire to build and operate a riding <br />arena also. Since the time of the application submittal, it was realized that the size of the <br />property was reduced from 10-acres to approximately 9.8-acres. This was due to the fact <br />that Sherburne County obtained additional right-of--way along the eastern portion of the site <br />for their County Road 13 project. The applicant will be applying for a variance to the <br />allowable Accessory Structure size. At 10-acres, they could build an 8,000 sgft building. <br />Once they are in the 5 to 10-acre size, they can only build a 4,000 sgft building. <br />Standards for Issuance of a Conditional Use Permit (Section 30-654) <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed <br />location: <br />7. Will not endanger, injure or detrimentally affect the use and enjoyment oj~otherproperty in the <br />immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the <br />neighborhood or the city. <br />2. Will be consistent with the comprehensive plan. <br />3. Will not impede the normal and orderly development and improvement of surrounding vacant <br />property. <br />4. Will be served adequately by and will not adversely affect essential public facilities and services <br />including streets, police and fireprotection, drainage, refuse disposal, water and seaa~er systems, parks <br />and schools; and will not, in particular, create tragic congestion or interference with traffic on <br />adjacent and neighboring public thoroughfares. <br />S:\PLANNING\Case Files\2006\CUP\CU 06-08 Refiners\CU 06-08_PC.doc <br />
