Planning Commission Minutes Page 3 <br />April 11, 2006 <br />--------------------------- <br />Julie Goldman, applicant-Stated she is currently licensed by the county but is working on <br />state licensure. She stated she will have to follow state requirements regarding fencing. <br />There being no one else to speak to this issue, Chair Lemke closed the public hearing. <br />MOVED BY COMMISSIONER ANDERSON AND SECONDED BY <br />COMMISSIONER SCOTT TO RECOMMEND APPROVAL OF A <br />CONDITIONAL USE PERMIT FOR CASE NO. CU 06-05 BASED ON THE <br />FOLLOWING CONDITIONS: <br />1. A MAXIMUM OF 300 STUDENTS SHALL BE ALLOWED TO ATTEND <br />THE SCHOOL/DAYCARE. <br />2. IF MORE THAN 300 STUDENTS ARE DESIRED IN THE FUTURE, <br />THE APPLICANT SHALL APPLY FOR AN AMENDMENT TO THE <br />CONDITIONAL USE PERMIT. <br />3. NO ON-STREET PARKING SHALL BE ALLOWED FOR THE <br />SCHOOL/DAYCARE. <br />4. THE FACILITY SHALL MEET ALL BUILDING AND FIRE CODES. <br />5. THE SCHOOL/DAYCARE MUST MEET ALL STATE/COUNTY <br />GUIDELINES. <br />MOTION CARRIED 7-0. <br />5.3. Request by Ebert Construction for Conditional Use Permit to Construct 5,990 sq. ft. <br />Commercial Building (Pearle Vision) in Elk River Center, Public Hearing-Case No. CU 06- <br />07 <br />Mr. Leeseberg stated the applicant is requesting a conditional use permit for constructing a <br />Pearle Vision Center in Elk River Center. He reviewed the building design, parking, <br />landscaping, and drainage as outlined in his staff report. Mr. Leeseberg stated condition #6 <br />should be changed to "... prior to Certificate of Occupancy being issued." <br />Chair Lemke stated the gable in the rear concept plan should be included as a condition. He <br />questioned if the applicant is meeting the lighting requirements. <br />Commissioner Stevens questioned when US Bank would be complying with the lighting <br />requirements. <br />Mr. Leeseberg stated he has been working on it. <br />Chair Lemke opened the public hearing. <br />Scott Borsch, Ebert Construction-Stated he would like to see condition #5 removed. He <br />stated they do meet the lighting requirements. <br />There being no one to speak to this issue, Chair Lemke closed the public hearing. <br />Commissioner Stevens commented he liked the design of the project. <br />
