Case File: OA 07-O1 <br />Page 3 <br />Commercial Reserve Ordinance <br />City of Elk River <br />3 Swimming pools shall be set back a m±nimum of eight feet from the side yard and rear yard lot <br />lines and must comply with the required front yard setback as per this subdivision. Swimming pools <br />must be completely enclosed with an opaque chain link or equivalent fence at least four feet high <br />with a lockable gate. <br />Background/Discussion <br />Included in the 2004 Comprehensive Plan were two areas identified as Commercial Reserve. The intent <br />of these areas was to reserve land for future commercial development, avoiding land use improvements <br />inconsistent with a final vision of the area while still allowing appropriate use of the land that does not <br />require major investment in infrastructure or buildings. <br />Within its staff report regarding the Aggregate Industries subdivision in January of this year, the City <br />Council authorized staff to generate an ordinance for consideration. <br />Financial Impact <br />None <br />Attachments <br />None <br />Analysis <br />Staff has prepared an ordinance that regulated the direction endorsed by the Comprehensive Plan.
