Case File: CU U7-25 Stoneworks <br />Page 3 <br />During the public review, it was noted by the applicant that the majority of the work would be <br />conducted indoors, but certain functions would be accomplished on the west side of the then <br />proposed metal building. It was not noted what functions would occur outdoors. <br />Over the summer, City staff received complaints from an adjacent resident regarding the noise and <br />dust from the sandblasting operation. This operation is staged north of the main building. <br />Additional complaints received from the same resident regarding the hours this business is <br />operating, and a concern with the business using the 211 the private road as an access, in violation of <br />their Condition Use Permit condition. <br />While the CUP does not explicitly prohibit work outdoors, or the hours of operation, staff has asked <br />that the business approach the Planning Commission and Cit<~ Council to memorialize the <br />appropriate actions, and to provide the affected property owners an opportunity- to provide input. <br />In response, the applicant proposes the following, with respect to hours: <br />• General Hours of operation: Gam to 6 pm, 7 days a week <br />• Outside hours of operation: lam to 6 pm, M-F, Sam-5p S/S <br />• Outside work would include cutting, sandblasting, power washing. <br />Applicable Regulations <br />Conditional Use Permit <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br />7. l~'il/ not endanger, injure or detrimentally affect the use and enjoyment of other proper; in the immediate <br />rricini~~ or the public health, safety, morals, comfort, convenience orgenera/ welfare of the neighborhood or the <br />city. <br />2. i~'ill be consistent with the comprehensive plan. <br />3. Dill not impede the normal and orderly development and improvement of surrounding vacant property. <br />4. Will be served adequately by and will not adversely affect essential public facilities and services including <br />streets, police and fire protection, drainage, refuse disposal, water and sewer ystems, parks and schools; and <br />will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public <br />thoroughfares. <br />5. mill not involve uses, activities, processes, materials, equipment and conditions of operation that will be <br />detrimental to any persons or property because of excessive tra~c, noise, smoke, fumes, glare, odors, dust or <br />vibrations. <br />6. bill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. <br />7.
