MEETING OF THE ELK RIVER BOARD OF ADJUSTMENTS HELD AT THE ELK RIVER CITY HALL TUESDAY, AUGUST 14, 2007 Members Present: Chair Stevens, Commissioners Austad, Lemke, Scott, Staul and Westgaard Members Absent: Commissioner Anderson Staff Present: Planning Manager Jeremy Barnhart, Senior Planner Sheila Cartney, Park Planner/Planner Chris Leeseberg, Recording Secretary Debbie Huebner Call Meeting To Order Pursuant to due call and notice thereof, the meeting of the Elk River Board of Adjustments was called to order at 6:30 p.m. by Chair Stevens. 2. Consider August 14, 2007 Board of Adjustments Agenda MOVED BY COMMISSIONER AUSTAD AND SECONDED BY COMMISSIONER WESTGAARD TO APPROVE THE AUGUST 14, 2007, PLANNING COMMISSION AGENDA AS PRESENTED. MOTION CARRIED 6-0. 3.1. Consider July 10. 2007 June 12, 2007 Board of Adjustments Minutes MOTION BY COMMISSIONER STAUL AND SECONDED BY COMMISSIONER LEMKE TO APPROVE THE JUNE 12, 2007 BOARD OF ADJUSMENTS MINUTES. MOTION CARRIED 6-0. 3.2. Consider July 10, 2007 Board of Adjustments Minutes MOTION BY COMMISSIONER STAUL AND SECONDED BY COMMISSIONER AUSTAD TO APPROVE THE JULY 10, 2007 BOARD OF ADJUSTMENTS MINUTES. MOTION CARRIED 6-0. 4. Recfuest by Robert and Heidi Anderson for Setback Variance. Case No. V 07-06 -Public I Hearne Mr. Barnhart stated that the applicants are requesting a variance of 21 feet from the required front yard setback of 35 feet in order to construct a detached garage. He explained the uniqueness of the property, noting that the proposed garage would not stand out from other residences and garages in the neighborhood. Staff recommends approval of the request as illustrated on drawings dated August 14, 2007. Chair Stevens opened the public hearing. There being no public comment, Chair Stevens closed the public hearing. Comissioner Westgaard stated he was in agreement with staff's recommendation in favor of approval, given the circumstances of the property.
