• • Penalties <br />1. Any person violating the provisions of the open burning ordinance <br />shall be guilty of a misdemeanor, and upon conviction, shall be <br />punished by a fine of up to seven hundred dollars and/or imprisonment <br />for a term not to exceed ninety days. The violator may also be held <br />accountable for the costs of prosecution and the cost incurred from <br />suppression of the fire. <br />• Revision of Open Burn Areas in City of Elk River <br />1. The existing open burning ordinance does not allow open burning in <br />the urban service district of the City or in platted areas of the rural <br />service district where the lots average one acre or less in size. (See <br />attached copy of "Existing Open Burning Map." <br />2. In order to better regulate and enforce the areas of open burning in the <br />City, it was felt that it would be best to consolidate the "open burn <br />area" in the City of Elk River. The attached "Proposed 1995 Open <br />Burn Area Map" shows the areas of the City that staff is proposing <br />that no burning take place. <br />RECOMMENDATION <br />It is recommended that the Council review the proposed ordinance and map. <br />Following Council review, it is recommended that a motion be passed <br />adopting the proposed open burning ordinance and attached map. <br />• <br />
