• Resolution No. 07-94 <br />A RESOLUTION OF THE CITY OF ELK RIVER CITY COUNCIL <br />A RESOLUTION EXTENDING A MORATORIUM ON THE ISSUANCE OR <br />TRANSFER OF LICENSES FOR THE SALE OF TOBACCO PRODUCTS. <br />WHEREAS, the City Council of the City of Elk River, on July 16, 2007, imposed asix- <br />month moratorium on the licensing of tobacco sales for establishments <br />where the sale of tobacco products and smoking supplies is the primary <br />business of the establishment; and <br />WHEREAS, the purpose of the moratorium was to have City staff research and prepare <br />fox Ciry Council consideration amendments to the City's ordinance <br />requirements fox the issuance of licenses fox tobacco sales; and <br />WHEREAS, City staff has commenced its investigation and research into the issues <br />identified by the City Council, but will need additional time to prepare <br />proposed ordinance amendments fox City Council consideration. <br />NOW, THEREFORE BE IT RESOLVED by the Ciry Council of the City of Elk River, <br />Minnesota: <br />• 1. That the moratorium on tobacco licensing shall be extended to and including <br />July 15, 2008, unless earlier revoked by resolution of the City CouncIl. <br />2. That during the maratorium period, the City shall not issue any new license <br />fox the sale of tobacco, nor approve the transfer of any existing license to a new licensee, fox <br />any establishment where the sale of tobacco products and smoking supplies is the primary <br />business of the establishment. <br />3. That the extension of the moratorium shall take effect upon adoption of this <br />resolution. <br />Passed and adopted the 13`x' day of November, 2007. <br />Steph nie A.
