Providing for Their Issuance and Levying a Tax for the Payment Thereof- <br />Economic Development Authority Action <br />MOVED BY COMMISSIONER DWYER AND SECONDED BY COMISSIONER <br />TVEITE TO ADOPT RESOLUTION 07-08 ACCEPTING OFFER ON THE <br />SALE OF $10,000,000 GENERAL OBLIGATION BONDS, SERIES 2007, <br />PROVIDING FOR THEIR ISSUANCE AND LEVYING A TAX FOR THE <br />PAYMENT THEREOF. MOTION CARRIED 7-0. <br />There being no further business, Chair Gongoll adjourned the meeting of the Elk River City <br />Council at 6:45 p.m. <br />5.3.B. Resolution Authorizing a Continuing Disclosure Undertaking with Regard to the Issuance <br />of $10.000.000 General Obligation Bonds. Series 2007 of the Economic Development <br />Authority for the-Gifu of Elk River-City Council Action <br />MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY <br />COUNCILMEMBER FARBER TO ADOPT RESOLUTION 07-82 <br />AUTHORZING A CONTINUING DISCLOSURE UNDERTAKING WITH <br />REGARD TO THE ISSUANCE OF $10,000,000 GENERAL OBLIGATION <br />BONDS, SERIES 2007 OF THE ECONOMIC DEVELOPMENT AUTHORITY <br />FOR THE CITY OF ELK RIVER, MINNESOTA. MOTION CARRIED 5-0. <br />6.1. Appeal of Board of Adjustments Decision for Denial of Request by Ross Hjermstad for <br />Setback Variance for an Accessory Structure Case No V 07-08 Aublic Hearing <br />Mr. Barnhart presented the staff re ort that was submitted b Ms. Cartne . <br />P Y Y <br />Councilmember Gumphrey questioned if front yard setbacks have been granted in the past. <br />Mr. Barnhart stated they have but he would need to check the history on them. <br />Mayor Klinzing opened the public hearing. <br />Ross Hjerrnstad, applicant-Stated he has his own business and needs storage space. He <br />stated he has had to put the house up for sale because the site would no longer fit his needs. <br />He stated there would be no encroachment to the county road. <br />Mayor Klinzing closed the public hearing. <br />Councilmember Farber questioned the amount of footage the applicant would actually be <br />from the road. <br />It was noted that the distance from the new addition to the side of the road would be 70 feet <br />and the actual measurement for setbacks is taken .from the property line, not the right-of- <br />way. <br />Councilmember Zerwas stated Mississippi Road is busy and this addition wouldn't have a <br />negative impact in the area. <br />• <br />
