REQUEST FOR ACTION

To
Ci Council
Agenda Section
Consent
Item Description
Land Swap Between Fire Station No.1 Gackson Avenue) and
Sherburne County Highway Department

Meeting Date
Se tember 4, 2007

Item Number
3.5.*

Prepared by
Ter Maurer, Public Works Director
Reviewed by

Reviewed by

Action Requested
Approval of a quitclaim deed to transfer property from the City of Elk River to Sherburne County.

Backiround/Discussion
The attached exhibit is of the area between Fire Station No.1 and Sherburne County Public Works
Department on Jackson Avenue. As indicated by the exhibit, the Fire Station north property line is
approximately 3' north of the building. There is also a portion of the Fire Station property at the west
side that extends northerly behind the Sherburne County Public Works Department. We have been
discussing a potential land swap with Sherburne County since the ambulance bay construction has been
completed. What is being proposed is that the City will quitclaim to Sherburne County an area of 3,427
square feet immediately north of the Sherburne County Public Works facility. In exchange for that,
Sherburne County will quitclaim to the City of Elk River an area of 1,200 square feet adjacent to the
remainder of the City of Elk River property. This is the area where the Fire Departmcnt often times does
training exercises. In addition, Sherburne County will provide approximately 6,000 square feet of ingress
egress easement over their paved area so that we will have the right to drive on their property to access
the Fire Station garage doors. This has been happening informally for a nutnber of years.

This land swap will formalize the ability to utilize Sherburne County property for ingress and egress to the
City Fire Station. Should Sherburne County not be the owner of this building in the future, it is
important that we formalized this transaction and have the rights established.

Financial Impact
Nonc.

Attachments

.
