<br />Case File: CU 07-18 <br />Page 3 <br /> <br />Waste Management <br />Conditional Use Pennit <br /> <br />The issuance of a Conditional Use Pennit can be ordered only if the use at the proposed location: <br /> <br />,. Will not endanger, injure or detrimentallY affect the use and enjoyment of other propertY in the immediate vicinity or <br />the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. <br />2. Will be consistent with the comprehensive plan. <br />3. Will not impede the normal and orderlY development and improvement of surrounding vacant propertY. <br />4. Will be seroed adequatelY f?y and will not adverselY affect essential public facilities and services including streets, police <br />and fire protection, drainage, refuse disposal, water and sewer {Ystems, parks and schools; and will not, in particular, <br />create traffic congestion or inteiference with traffic on a4jacent and neighboring public thoroughfares. <br />5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to <br />a'!Y persons or propertY because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. <br />6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of mqjor importance. <br />7. Will fullY complY with all other requirements of this Code, including a'!Y applicable requirements and standards for the <br />issuance of a license or permit to establish and operate the proposed use in the city. <br /> <br />If denial of such a pennit should occur, it shall accompany recommendations or determinations by <br />findings or a report stating how the proposed use does not comply with the standards set forth in Section <br />30-654. <br /> <br />In the review of the standards for CUP as outlined, it appears that the request is consistent with all of <br />these standards. <br /> <br />Analysis <br />The land use is consistent with the land use plan and the pattern of development in that area. The need <br />for service and office buildings is customary to the approved use. The Building department, in their <br />review, has raised some issues, including the need to complete the CO on the recendy approved building, <br />and the drawing of the plans by a licensed architect. <br /> <br />The primary focus of staff and the Planning Commission was the building materials used for the new <br />addition and storage building. The Planning Commission and Council had earlier tried to create a campus <br />concept in the land fill area, having all buildings match the gas plant. Because the new addition (on the <br />north side of the building, away from the entrance drive) would not be readily visible to the public, the <br />Planning Commission felt that metal would be acceptable, so long as the color was consistent in color to <br />the gas plant. At the Planning Commission meeting, the Commission learned that the applicants wants to <br />use the storage building for a short period of time, 2 years, until a new house hold waste (HHW) building <br />is approved and built. With the information, the Planning Commission felt that metal on this building <br />would be acceptable, given the time frame suggested. The Fire Chief has suggested a meeting to so that <br />the applicant can fully understand the Fire Code requirements. <br /> <br />Comprehensive Plan <br />The use of the land is consistent with the Comprehensive Plan. <br /> <br />Landscapinl <br />In the previous approval, a condition was stated that 5 additional shade trees be added. These trees <br />should still be added, as well as some foundation plantings around all buildings. It is suggested that staff <br />approve the landscaping plan. <br />
