Box 490 <br />Elk River, MN 55330 <br /> <br />RE: HILLSIDE CROSSING/HILLSIDE ESTATES 3RD AND 4TH ADDITIONS <br />ASSESSMENTS <br /> <br />Dear Ms. Johnson: <br /> <br />As you are aware, there are improvements that have taken place in both the Hillside <br />Crossing development and previously in the Hillside Estates 3rd and 4th Additions which <br />now need to be assessed against those properties. Both of these projects have Developer's <br />Agreements on them which waive the Developer's rights to a public hearing for the <br />assessments; therefore, it only takes simple Council action to levy the assessments. The <br />Hillside Crossing project consists of internal lateral sanitary sewer, water, and storm <br />sewer. An appropriate credit for the oversizing of the watermain has been applied previous <br />to this assessment. The Developer financed the street improvement himself. The <br />assessments have been spread according to the percentages and over the period of time <br />specified in the Developer's Agreement. There is a resolution attached for the City <br />Council's consideration which adopts this role. <br /> <br />The Hillside Estates 3rd and 4th Additions assessment has to do with the improvements put <br />in place when trunk watermain was extended from Hillside Estates 1st Addition to the new <br />500,000 gallon water tower in the northeast part of this area. At that time, it was indicated <br />that no assessments would be levied until such time as trunk sanitary sewer and water was <br />available so the properties could be developed. This has recently been accomplished with <br />the Elk Park Center trunk utilities extension, therefore, it is appropriate to assess the <br />improvements at this time. All the sanitary sewer in this project was lateral; therefore, <br />100 % of the cost is proposed to be assessed against the Hillside Estates 3rd and 4th area. <br />Because the watermain in question was a trunk line leading to the water tower, the <br />assessment is based on a lateral benefit of $20.00 per front foot against the frontage of the <br />proposed plats. These two improvements total $161,456.00. At this point in time, neither <br />plat has been filed nor has a Developer's Agreement been entered into. Therefore, it will <br />be levied as one lump sum against the unplatted parcel. In the future, when the plats are <br />filed, this assessment will have to be respread against each individual lot.
