Resolution Approving Summary Publication of this
Ordinance

Meeting Date
une 18, 2007

Item Number
3.7*
Prepared by
Rebecca Hau ,Environmental Admin
Reviewed by
Loti ohnson, Ci Administrator
Reviewed by

B.

Action Requested
Staff is recommending adoption of the attached Stormwater and Excavating, Grading, & Erosion Control
ordinances. Due to the length of the ordinances, staff is also recommending adoption of the attaehed
resolutions approving summary publication of each ordinance.

Background/Discussion
At the April 16, 2007 City Council meeting, staff gave an update on the City of Elk River's NPDES
permit requirements. As stated at that meeting, a component of the permit is to adopt a Storm Water
Ordinance. An ordinance was provided to you at the meeting for your review. One change that has been
made since that meeting is in reference to penalties. This seetion has been omitted after review by the
City Attorney.

The City currently has a section in the ordinance on Erosion and Sediment Control (see. 30-416);
however, it does not cover all of the areas we ate required to undet the NPDES permit. Staff is
requesting that this section be repealed and replaeed with the attached Excavating, Gtading & Erosion
Control Otdinance. It is much more detailed as to what the requirements are.

The proposed Storm Water Ordinance is new. The language contained in this ordinance is similar to a
majority of other communities such as Woodbury, Valley Branch Watershed District, Brown's Creek
Watershed District, and Ramsey-Washington Metro Watershed District. The language is from sample
ordinances provided by the Minnesota Pollution Control Agency (MPCA) and the Northland Nonpoint
Education for Municipal Officials (NEMO) Program.
