<br />r / ~'\( <br />( )! <br />~l}(' River <br /> <br />. <br /> <br />. <br /> <br /> <br />October 10, 1994 <br /> <br />Ed Norell <br />17810 Halas Street NW <br />Anoka, MN 55303 <br /> <br />Dear Mr, Norell: <br /> <br />. <br /> <br />Last week I contacted MnDot to begin the process of obtaining a special use <br />permit for the construction of a Veteran's Memorial within MnDot right of <br />way along Highway 10 and the Oxford intersection, Enclosed is a letter from <br />MnDot as a follow up to my conversation with them, which states <br />construction of the Veteran's Memorial may proceed with the understanding <br />the memorial will be located within a specifically identified area as <br />illustrated on the attached map. Also, it should be noted that the letter <br />makes reference to a bike trail, which is a trail the City has been working <br />cooperatively with MnDot to establish from the downtown area to Orono <br />Park, The trail will pass through the same piece of right of way that the <br />memorial will be placed on, however, the two improvements should not affect <br />one another; conversely will compliment each other as the use of that <br />property. <br /> <br />Before proceeding any further with preparing plans or ordering the <br />monument from the company you are working with, this issue of a limited <br />use permit will be taken to the City Council on October 17, 1994. As it <br />stands right now, the limited use permit will be issued to the City of Elk <br />River for use of MnDot right of way. Therefore, I would suspect that the City <br />will have to enter into some agreement with the American Legion relative to <br />general maintenance around the monument area as well as the liability or <br />any claims for damages that may arise in the future, Therefore, an <br />agreement between the Legion and the City would be appropriate. <br /> <br />. <br /> <br />On the attached site plan I have indicated a possible location of the Veteran's <br />Memorial as well as a possible alignment of the futme trail system. To <br />confirm the location and overall design of this piece of property, it may be <br />appropriate to develop a site plan for the subject property, <br /> <br />P.O.
