<br />I ~~( <br />( )! <br />IIi( River <br /> <br />ITEM 5.2. <br /> <br /> <br />MEMORANDUM <br /> <br />TO: <br /> <br />MAYOR & CITY COUNCIL <br /> <br />FROM: <br /> <br />WILLIAM RUBIN, ECONOMIC <br />DEVELOPMENT COORDINAT~V1- <br /> <br />OCTOBER 17, 1994 <br /> <br />DATE: <br /> <br />SUBJECT: MODIFICATION TO EDA ENABLING <br />RESOLUTION <br /> <br />INTRODUCTION <br /> <br />. <br /> <br />On Monday, October 17, 1994, the Elk River City Council will be asked to <br />schedule a public hearing to consider a modification to the Resolution which <br />created the Economic Development Authority for the City of Elk River. The <br />proposed modification relates to the initiative of adding at least one more at- <br />large Commissioner at the expense of reducing the number of City Council <br />members on the EDA. <br /> <br />BACKGROUND <br /> <br />The current composition of the Elk River EDA is that of a seven member <br />Board of Commissioners; five of which are City Council members and two of <br />which are non-elected residents who serve in an at-large capacity. A seven <br />member EDA is the statutory maximum. Further, State Law provides that <br />at least two of the seven Commissioners must be members of the City <br />Council. This requirement helps ensure a checks-and-balance system. <br /> <br />~ <br /> <br />Minnesota Statutes addresses how an Enabling Resolution can be modified. <br />It requires that a City Council conduct a public hearing on the proposed <br />modification, after the notice of the public hearing is published once a week <br />for two consecutive weeks. The first publication must appear not more than <br />thirty days from the date ofthe public hearing. <br /> <br />With that background, the following timetable is offered: <br /> <br />October 17. 1994 - City Council meeting - City Council sets public <br />hearing date on proposed modification to the Enabling Resolution <br /> <br />. <br /> <br />P.O.
