Further, any and all <br />mining must be consistent with the long range planning and findings of the <br />Environmental Impact Statement (EIS) prepared by the City. Lastly, not <br />being part of this rezoning or the EIS does not preclude other areas within <br />the City from being considered for mineral excavation, if requested. <br /> <br />This rezoning of the mining district is the logical next step in the City's <br />attempt to better regulate mining activities. The first step in this process <br />was the Environmental Impact Statement. The next step, after the zone <br />change, will be updating any antiquated existing mining permits. An <br />ongoing step is to better administer the yearly licenses. <br /> <br />The Planning Commission is recommending approval of this zone change <br />request with the exception of the northeast quarter of the southwest quarter <br />of Section 20, Township 33, Range 26 (Shown on Map B with an X through <br />it). This parcel is currently not owned or leased by gravel companies and <br />makes a logical separation from mining activities to adjacent neighborhoods. <br /> <br />. <br /> <br />Staff also considered not rezoning areas where setbacks from mining <br />activities would be required. However, it was too difficult to predetermine <br />these buffers at this time. This task would be easier to accomplish on a case <br />by case basis through the Conditional Use Permit process. <br /> <br />Attached, is an Ordinance Amendment for the approval of this rezoning. <br />Included in the amendment are the Planning Commission's findings. <br /> <br />. <br /> <br />ZC94-09/council <br />
