Mineral Excavation
Case No.ZU 94-09
Continued

Page 2

.

be considered prior to approving mineral excavation. Further, any and all
mining must be consistent with the long range planning and findings of the
Environmental Impact Statement (EIS) prepared by the City. Lastly, not
being part of this rezoning or the EIS does not preclude other areas within
the City from being considered for mineral excavation, if requested.

This rezoning of the mining district is the logical next step in the City's
attempt to better regulate mining activities. The first step in this process
was the Environmental Impact Statement. The next step, after the zone
change, will be updating any antiquated existing mining permits. An
ongoing step is to better administer the yearly licenses.

The Planning Commission is recommending approval of this zone change
request with the exception of the northeast quarter of the southwest quarter
of Section 20, Township 33, Range 26 (Shown on Map B with an X through
it). This parcel is currently not owned or leased by gravel companies and
makes a logical separation from mining activities to adjacent neighborhoods.

.

Staff also considered not rezoning areas where setbacks from mining
activities would be required. However, it was too difficult to predetermine
these buffers at this time. This task would be easier to accomplish on a case
by case basis through the Conditional Use Permit process.

Attached, is an Ordinance Amendment for the approval of this rezoning.
Included in the amendment are the Planning Commission's findings.

.

ZC94-09/council
