At the time, Mr. Ron Kuhn, the <br />developer for the Shores of Briarwood, was proposing a three (3) lot <br />subdivision to be served by on-site septic systems. Because of Kliever's <br />Marsh, which is designated as a Natural Environment (N.E.) lake by the <br />Department of Natural Resources (DNR), the proposed lots required <br />variances from the Shoreland Ordinance to comply with City Code. In 1989, <br />all structures were required to meet a two-hundred (200) foot setback from <br />. the Ordinary High Water Mark (O.H.W.). Variance requests were approved <br /> <br />P.O.
