<br />insurance, comprehensive general liability insurance and workers compensation insurance, all in amounts <br />reasonably acceptable to Lessor. <br /> <br />Section 7.05. Waiver of Subrogation. Notwithstanding any provision of this Lease to the <br />contrary, if either party hereto suffers a loss or damage, and such loss or damage would typically be <br />covered under any policy of insurance that such party actual1y maintains or is required to maintain <br />pursuant to this Lease, then such party hereby releases the other party from any and al1liability for each <br />such loss or damage, notwithstanding that such loss, damage or liability may arise out of the negligent or <br />intentionally tortious act or omission of the other party, its agents, officers or employees and/or <br />notwithstanding that such party has failed to maintain the insurance policy required to be maintained by it <br />under this Lease. All insurance policies maintained by Lessor and Lessee as provided in this Section shall <br />contain an agreement by the insurer waiving the insurer's right of subrogation against the other party to <br />this Lease or agreeing not to acquire any rights of recovery which the insured has expressly waived prior <br />to loss. Each of the parties hereto agrees that if the provision waiving subrogation in any of such policies <br />of insurance requires that notice of such waiver be served upon the insurer, such notice shal1 be promptly <br />served by the party obtaining such insurance. <br /> <br />(The remainder of this page is intentionally left blank.) <br /> <br />21 <br />
