Box 490 <br />Elk River, MN 55330 <br /> <br />RE: NORTHEAST AREA UTILITIES <br />CHANGE ORDER NO.2 <br /> <br />Dear Council Members: <br /> <br />As you are aware, the underground utility improvements in the Hillside Crossing <br />development are proposed to be accomplished by means of a change order to the existing <br />Arcon Construction project. Attached is a copy of the change order to accomplish this. <br />These prices have been previously reviewed by the Developer, Mr. Rick Foster, and he is <br />in agreement with this change order. Originally, it was thought that the public street <br />improvement on Evans A venue would also be part of the change order; however, we were <br />unable to reach a satisfactory price for this work. Therefore, the Developer, Mr. Foster, <br />will be contracting independently for the street improvements along with all of his necessary <br />private parking lot improvements. <br /> <br />We would recommend City Council approval of this change order contingent upon the <br />Developer meeting the necessary conditions for implementation of the construction. These <br />would primarily consist of signing a Developer's Agreement, filing the plat, and providing <br />the City with the necessary easements for the proposed improvements. <br /> <br />If you have any questions regarding this change order, I will be in attendance at your <br />August 22, 1994, City Council meeting. <br /> <br />Sincerely, <br /> <br />MSA, CONSULTING ENGINEERS <br /> <br />~jK~~ <br /> <br />Terry J.
