<br />Rezoning Request, City <br />August 15, 1994 <br /> <br />Page 4 <br /> <br />. <br /> <br />AMORTIZATION PERIOD <br /> <br />If the City Council approves the requested rezoning, the zoning ordinance <br />currently allows a five (5) year amortization period before Custom Motors has <br />to vacate the property. Custom Motors has indicated that this five (5) year <br />period is not long enough for them to feasibly phase out their business at its <br />present location. Staff has indicated to Custom Motors that once the <br />rezoning issue is decided by the City Council, Custom Motors has the option <br />to request that the zoning ordinance be amended to extend the amortization <br />period to a period of greater than five (5) years. This code amendment would <br />have to be reviewed by the Planning Commission and approved by the City <br />Council to allow that period to be extended. <br /> <br />PLANNING COMMISSION RECOMMENDATION <br /> <br />The Planning Commission recommended approval to rezone the property <br />from 11 (Light Industrial) to RIb (Single Family Residential). <br /> <br />RECOMMENDATION <br /> <br />. <br /> <br />It is recommended the City Council approve the rezoning request based on <br />the attached Ordinance No. 94-_. Moving forward with the rezoning at this <br />time will remove the uncertainty of Custom Motors future. As long as the <br />land use plan and zoning map are in conflict, there remains the possibility for <br />a future council to bring back a rezoning request. Staff believes it would be <br />in the best interest for both the City and Custom Motors to move forward <br />with rezoning the property and begin working on an agreeable amortization <br />period, alternative locations for relocating the business, and available <br />financial programs. <br /> <br />. <br /> <br />custom.council <br />
