<br />This letter is in response to your request tor our opinion with respect
<br />to the proposed rezoning of the Custom Motors site.
<br />
<br />BACKGROlJN"D
<br />
<br />It is our understanding that the Custom Motors site is located in an
<br />are~ of the City of Elk River (the City) which is primarily residenti~l
<br />and which is designated by the City's land use map'for residential use.
<br />However, the Custom Motors site itself was re~oned from A-l, Agricultura
<br />Conservation District, to 1-2 Medium Industrial District, by the city
<br />Council on November 3, 1978, and retains this zoning designation at the
<br />present time. The City Council also, on November 3, 1978, grented a
<br />Conditional Use Permit to Custom Motors permitting use of the site as
<br />a salvage yard, bodyshop, mechanical repair area and truck dealership.
<br />The Conditional Use Permit was granted subject to certain conditions,
<br />the most significant of which is appropriate screening. It is our
<br />understanding that the site has been used as a salvage yard, body shop ,
<br />mechanical repair area and truck dealership in the period since 1978,
<br />and that, while there was some delay in doing so, the required screening
<br />ha~ now been put in place.

<br />You have advised us that the Planning Co~mission, in connection with a
<br />comprehens~ve review of nonconforming, inconsistent and inappropriate
<br />land uses ~n the City, has determined that the industrial use of the
