<br />Wendy's International <br />August 15, 1994 <br /> <br />Page 2 <br /> <br />. <br /> <br />The proposed site is a triangular piece of property located at the northeast <br />corner of 192nd, which is the access road off of Highway 169 and Freeport <br />Avenue. Similar to the main shopping center, this property has two (2) <br />utility easements bisecting the property. The fIrst is a one hundred (100) foot <br />utility easement for United Power Association (UPA) and the second is a <br />seventy-five (75) foot easement for Northern Natural Gas, which overlaps the <br />previously mentioned utility easement by fifty (50) feet. In total, the <br />easement is one hundred twenty-five (125) feet in width. These two utility <br />easements, along with the irregular shape of the parcel limit the possibilities <br />for designing the site. <br /> <br />SITE PLAN REVIEW <br /> <br />As part of the report to the Planning Commission dated July 26, 1994, a <br />complete list of comments regarding the site plan review for Wendy's <br />development plan is included. Please refer to the Planning Commission <br />report for specific comments regarding the development plan submitted by <br />Wendy's. For the most part, the comments outlined in the report have been <br />met or can be accommodated by Wendy's. Staff has met with Wendy's and <br />they concur with the comments outlined in their letter. <br /> <br />. PLANNING COMMISSION RECOMMENDATION <br /> <br />The Planning Commission unanimously recommended approval of the <br />conditional use permit request by Wendy's International with the conditions <br />set forth in the staff report as well as including a general comment that <br />Wendy's include some additional landscaping within the northerly triangular <br />portion of their property. In addition, the Planning Commission expressed <br />their appreciation to Wendy's for submitting a complete set of plans. <br /> <br />RECOMMENDATION <br /> <br />It is recommended the City Council recommend approval of the conditional <br />use permit request by Wendy's International to construct a restaurant <br />facility in the Elk Park Center Planned Unit Development with the following <br />condition: <br /> <br />1. ALL COMMENTS STATED WITHIN THE JULY 26, 1994, <br />REPORT TO THE PLANNING COMMISSION, INCLUDING <br />TERRY MAURER'S MEMO DATED JULY 19, 1994, BE <br />INCORPORATED INTO THE PROPOSED DEVELOPMENT <br />PLANS. <br /> <br />. <br /> <br />wendys.council <br />
