THIS FEE SHALL BE AT <br />THE RATE APPLICABLE AT THE TIME OF FINAL PLAT <br />RECORDING. <br />B. WATER AND SANITARY SEWER TRUNK FEES. THE <br />DEVELOPER AGREES TO PAY TRUNK FEES AT THE RATE <br />ESTABLISHED BY COUNCIL FROM TIME TO TIME. <br />C. THE DEVELOPER SHALL PAY $1,000 PER LOT AS THEIR PRO <br />RATA SHARE OF CLEVELAND STREET IMPROVEMENTS, OR <br />$449,000. <br />D. A SURFACE WATER MANAGEMENT FEE SHALL BE PAID AT <br />THE TIME THE FINAL PLAT IS RELEASED FOR RECORDING. <br />16. PARK DEDICATION SHALL BE PROVIDED IN THE FOLLOWING <br />MANNER: <br />A. 7.25 ACRE CITY PARK SOUTH OF THE POTENTIAL SCHOOL. <br />B. .8 ACRES OF USEABLE OPEN SPACE ONTHE SOUTH SIDE OF <br />THE PLAT <br />C. REMAINDER SHALL BE EQUAL TO 67.5% MULTIPLIED BY THE <br />NUMBER OF LOTS IN THE PHASE BEING FINAL PLATTED, <br />MULTIPLIED BY PARK DEDICATION FEE ESTABLISHED AT <br />THE TIME THE FINAL PLAT IS RELEASED. <br />17. COVENANTS SHALL BE PREPARED TO REGULATE MINIMUM HOUSE <br />SIZE, BUILDING MATERIALS, ETC. <br />18. A TRUNK SANITARY SEWER AND WATER ASSESSMENT SHALL BE <br />LEVIED OVER THE ENTIRE PARCEL, EXCLUSIVE OF THE COUNTY <br />ROAD RIGHT OF WAY AND WETLANDS, AT THE TIME OF THE FIRST <br />FINAL PLAT. THE ASSESSMENT RATE SHALL BE AS ESTABLISHED <br />BY THE CITY COUNCIL FOR THAT YEAR. WHEN LEVIED, NONE OF <br />THE ASSESSMENT SHALL BE APPORTIONED TO THE SCHOOL SITE <br />OR PARK PROPERTIES. <br />19. A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST OF <br />THE IMPROVEMENTS SHALL BE SUBMITTED PRIOR TO THE <br />RELEASING OF THE FINAL PLAT FOR RECORDING. <br />20. THE LAND USE AND BULK REGULATIONS FOR THE SUBJECT <br />PROPERTY SHALL BE INCORPORATED INTO THE ZONING <br />ORDINANCE FOR ADMINISTRATION PURPOSES. THIS SHALL BE <br />COMPLETED PRIOR TO RELEASE OF THE INITIAL FINAL PLAT. <br />21. THE APPLICANT SHALL EXECUTE A DEVELOPER'S AGREEMENT <br />OUTLINING THE TERMS AND CONDITIONS OF APPROVAL FOR THE <br />FINAL PLAT. <br />22. ALL REQUIRED SUBDIVISION/PARK INFORMATION SHALL BE <br />PROVIDED IN AN ELECTRONIC FORMAT (.DWG FILE) AS REQUIRED <br />BY THE CITY ORDINANCE AND LAND USE APPLICATION PRIOR TO <br />RECORDING OF THE PLAT. <br />23. BEFORE THE FINAL PLAT OF A SECOND PHASE IS APPROVED, THE <br />WETLAND RESTORATION SHALL BE COMPLETED, THE NORTHERN <br />PARK PROPERTY AND THE SCHOOL PARCEL SHALL BE GRADED <br />GENERALLY FLAT AND SEEDED. <br /> <br />. <br /> <br />. <br /> <br />MOTION CARRIED 5-0. <br /> <br />. <br />
