<br /> <br />City of Elk River <br />REQUEST FOR COUNCIL ACTION <br />Agenda Section Meeting Date <br />Communi Devdo ment March 19, 2007 <br />Item Description <br />Deetfidd 3"' Addition Street/Storm Drainage Reconstruction <br />Assessment Heatin <br /> <br />Item Number <br />5.1. <br />Prepared by <br />Te Maurer, Ci <br />Reviewed by <br /> <br /> <br />Introduction <br />The Deerfidd 3"' Addition Street/Storm Drainage Reconstruction assessment heating is <br />scheduled for this evening's City Council meeting. I will be prepared with a brief PowerPoint <br />presentation and available to answer questions that the City Council or public may have after the <br />presentation. <br /> <br />Discussion <br />As part of my presentation, I will follow-up on the direction given regarding sidewalks at the <br />public heating. I will provide an analysis of 4 ft. versus 6 ft. wide sidewalk. In addition, I will <br />discuss the side of street and the width of boulevard that I am recommending. <br /> <br />Construction bids are scheduled to be opened at 1 p.m. on Thursday, March 15,2007. Therefore, <br />an analysis of the actual construction bids will part of my PowerPoint presentation. I will also <br />have a handout for the City Council, summarizing the bid opening. <br /> <br />Part of my presentation will touch on the property owners' rights relative to an appeal of the <br />assessment. It is important to remember that the property owners must submit a written <br />objection at or before the assessment heating in order to preserve their right to appeal the <br />assessment. Simply speaking at the public hearing and voicing an objection is not sufficient to <br />preserve the right to file an objection with the district coutt. <br /> <br />At the close of the assessment heating, it would be appropriate for the City Council to consider <br />the attached resolutions. The first one adopts the final assessment roll; this resolution can be <br />adopted with any revisions to the assessment roll that the City Council deems appropriate after <br />listening to testimony from the public. The second resolution awards the contract. It would only <br />be appropriate to consider this resolution if the resolution adopting the assessment roll is passed <br />by the City Council. I will have a completed resolution based on the bid opening that I will hand <br />out at Monday evening's meeting. <br /> <br />Financial Impact <br />The feasibility reports the total project cost at $4,730,500. Assessments to abutting properties in <br />the amount 0[$6,650 per residential parcd result in the total assessment of $1,303,400. The <br />remaining $3,427,100 is proposed to be funded by the City of Elk River. <br />
