A portion of Oudot A and all of Oudot D will be
consolidated into a new 20.7 acre parcel via an administrative subdivision. Oudot D is the comer
piece that is currendy zoned C-3, Highway Commercial.

Land Use Amendment and Zoning Change
As noted, Oudot D is currendy zoned C3, and guided as Highway Business. The applications
include a proposal to rezone and reguide the property to BP and Light Industrial, making the
proposed data center a permitted use (telecommunications center) on the created lot. However,
above ground storage tanks are a conditional use, requiring additional review. The proposed
changes to the land use map and zoning map are appropriate to serve a large land use that was not
contemplated at the time the zoning and land use maps were developed. The proposed changes do
not create a spot zoning instance, and are consistent with the predominate land use of the area.

S:\pLANNING\Case Files\2007\CUP\CU 07-04 United Health\Staff report CC 1-16-07.doc
