January 17, 2006 File: 226-046P Mr. Bob Wiegert Paramount Engineering & Design 1440 Arcade Street, Suite 200 St. Paul, MN 55106 RE: LIBERTY HEIGHTS ESTATES OF ELK RIVER Dear Mr. Wiegert 1bis correspondence is intended to document the discussion we had with you, Ross Abel from John Oliver & Associates, and Ed Dulak ofMeridan Development on Thursday, January 12, 2006. It will also document the discussion at the City Council workshop on Monday, January 9, 2006. At both of these meetings last week, the following items were discussed: 1. At the City Council workshop, the conclusion of the City Council was that your . development should have an average lot size of 11,000 square feet and a minimum lot size of 9,750 square feet, with a 75-foot frontage minimum. Attached are minutes from the City Council workshop which discuss this item. 2. I expressed concern that your project probably will not get to the City Council before Ap:ril, since the Environmental Assessment W orksheet(EA W) needs to be completed, reviewed by the City, and advertised by the EQB for 30 days prior to the Planning Commission meeting. Our Planning Commission will not act your development unless the EA W information is complete. With that being said, I express concern that the project may not get to the City Council before April. If this is the case, I will need the signed easement documents for the County Highway 40 right-of-way for both Liberty Heights Estates of Elk River and the Turner property prior to formal preliminary plat approval on either of these properties. As you are aware, I need to provide easement documentation to the Sherburne County Highway Department in March of this year. Ed indicated that he would talk to his legal counsel regarding this issue and get back to me. 3.
