<br />Case File: 06-03 <br />Page 9 <br /> <br />8. The buffer planting program shall be extended to the north side of the plat, along the <br />southem right-of-way line of County Road 33. <br />9. A detail of the fence within the buffer shall be provided. <br />10. Traffic calming measures as adopted by the City Council be incorporated into final <br />design drawings. <br />11. The northwest comer of the plat should be reconfigured to provide opportunity for <br />the exception pieces to be incorporated into the neighborhood, without irregular lot <br />shaped. <br />12. A tree preservation plan be developed and accepted by the environmental <br />administrator, to preserve, at minimum the following areas: <br />A. The rear portion of lots 2-8, Block 25. <br />B. The rear portion of lots 1-6, Block 24. <br />C. The rear portion oHots 4-9, 18-23, Block 9. <br />13. The following fees shall apply: <br />a. A seal coat fee shall be paid at the time the Final Plat is released for <br />recording. This fee shall be at the rate applicable at the time of final plat <br />recording. <br />b. Water and sanitary sewer trunk fees. The developer agrees to pay trunk fees <br />at the rate established by Council from time to time. . <br />c. The Developer shall pay $1,000 per lot as their pro rata share of Cleveland <br />Street improvements. <br />d. A Surface water management fee shall be paid at the time of final plat <br />recording. <br />14. Park dedication shall be provided in the following manner: <br />a. 9.98 acre City Park south of the potential schooL <br />b. 2 acres of open space in the southeast comer of the plat <br />c. The balance shall be form of cash in an amount relative to the percent of the <br />requirement not provided, applied equally to the number of lots. Fee to be <br />determined at the. time each phase is final platted. <br />15. Covenants be prepared to regulate minimum house size, building materials, etc. <br />16. A letter of credit in the amount of 100% of the cost of the improvements shall be <br />submitted prior to the releasing of the Final plat for recording. <br />17. The land use and bulk regulations for the subject property shall be incorporated into <br />the Zoning Ordinance for anministration purposed. This shall be completed prior to <br />release of the initial Final Plat. <br />18. The applicant shall execute a developer's agreement outlining the terms and <br />conditions of approvaL <br />19.
