<br />Case File: 06-18 <br />Page 3 <br /> <br />(4) The proposed subdivision makes adequate provision for water supply, storm <br />drainage, sewage transportation, erosion control and all other services, facilities and <br />improvements otherwise required in this article. <br />(5) The proposed subdivision will not cause substantial environmental damage. <br />(6) The proposed subdivision will not conflict with easements of record or with <br />easements established by judgment of a court. <br />(7) The proposed subdivision will not have an undue and adverse impact on the <br />reasonable development of neighboring land <br />(8) The proposed subdivision is not premature. A subdivision is premature if any of the <br />following exists: <br />a. Lack of adequate storm water drainage. <br />b. Lack of adequate roads. <br />c. Lack of adequate sanitary sewer systems. <br />d Lack of adequate offsite public improvements or support systems. <br /> <br />Rezoning <br />In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directlY and <br />indirectlY qfficted ry the proposal, the conservation if proper(} values, the use to which the proper(} qfficted is being <br />devoted at the time, and relevant provisions, if airy, in the land use plan. <br /> <br />Analysis <br /> <br />The subject property is zoned R1d, this district is intended to provide single-family residential <br />districts with larger lots and higher quality housing types in areas with full municipal utilities. This <br />district is intended to encourage the design of subdivisions that protect natural features while <br />providing high quality housing sites. The applicant is requesting to rezone this property to R1c, <br />which is intended to provide single-family residences in areas with full municipal utilities in areas <br />that are a continuation of existing residential development patterns and the infilling of existing lots <br />in established areas. There is a large single family development north of the subject site (River Park) <br />an application has been made for residential development to the northeast of this site. At this time <br />municipal utilities are not readily available to this site. <br /> <br />Comprehensive Plan <br />The subject property has an Urban Residential designation in the City of Elk River Comprehensive <br />Plan. Urban Residential include residential areas that will be served by the municipal sanitary sewer <br />system. These land uses include: single family detached housing, duplexes, townhomes and <br />multiple-family dwellings. <br /> <br />Rezoning - The subject side is zoned R1d, the applicant is requesting to rezone portions of the <br />property to R 1 c, in anticipation of being serviced by municipal utilities. Outlot A will not be rezoned <br />to R1c, it will remain R1d at this time as well as Outlot B; development is not proposed for these <br />lots, staff is comfortable not rezoning these outlots. The submitted plans show a possible <br />subdivision for Outlot A, which staff has not reviewed. All of Outlot C will be encompassed with a <br />drainage and utility easement and be included in the rezoning. <br /> <br />Lots - The proposed lots range from 11,050 square feet to 83,331 square feet, the minimum lot size <br />in the R1c district is 11,000 square feet.
