Ericson, Limited <br />Partners in Elk Park Center Limited Partnership, the developer of <br />the above Project. As such, we appeared before your Planning <br />Commission last Tuesday on the application for a conditional use <br />permit to change the Target store on the subject property from the <br />previously approved 90,000 square foot store to a 162,000 square <br />foot "Super Store." <br /> <br />The Ericsons oppose this change, and there is an arbitration <br />proceeding pending relating to whether this change will be <br />implemented. Accordingly, we believe that it is premature for the <br />City to approve the change in the Project until the arbitration <br />proceeding is resolved. The Demand for Arbitration of the General <br />Partners is enclosed for your reference. A substantial Counterclaim <br />will be asserted in the arbitration by the Ericsons, who also <br />intend to pursue all other remedies against all other persons until <br />this is satisfactorily resolved. <br /> <br />e <br /> <br />We suggest that the pending application for a conditional use <br />permit to expand the Target Store be tabled until the various legal <br />proceedings have been concluded.
