<br />Developer Agreement <br />Trott Brook Farms 12th <br />Page 4 <br /> <br />(03) Sidewalks, as required by the City (Sidewalk Improvements); <br /> <br />(04) Storm sewers, as required by the City, including all necessary catch basin, ditches, <br />inlets, retention areas and other appurtenances (Storm Sewer Improvements); <br /> <br />(05) Sanitary sewer laterals or extensions, as required by the City, including all necessary <br />building services and other appurtenances (Sanitary Sewer Improvements) ; <br /> <br />(06) Water main laterals or extensions, as required by the City, including all necessary <br />building services, hydrants, valves and other appurtenances (Water main Improvements) ; <br /> <br />(07) Wetland mitigation measures as required by the U.S. Army Corps of Engineers, the <br />Department of Natural Resources and/or the Wetland Conservation Act (Wetland <br />Mitigation); <br /> <br />(08) Landscaping. Boulevard and front yard trees as required by City Ordinance and any <br />additional landscape Improvements required by the City (Landscape Improvements). <br /> <br />a. Developer agrees to install landscaping materials in accordance with the <br />Landscape Plan, attached as EXHIBIT I. These materials shall include trees, <br />topsoil, and established turf grass. <br /> <br />b. All residential landscaping requirements should be completed pnor to <br />occupancy of the dwelling unit. <br /> <br />c. In the event the landscaping, including trees and establishment of turf, is <br />not complete at the time of Certificate of Occupancy, the City may issue a <br />temporary certificate of occupancy. <br /> <br />(09) Park and trails, as required by the City, including all park grading, removal of <br />specified vegetation, pavement of trails, and installation of park and trail signs including Park <br />boundary markers (5-foot steel posts) at all lot corners that border park property or City <br />owned outlots (park and Trail Improvements). <br /> <br />(10) Temporary and permanent erosion and sediment control measures as required by <br />the approved Storm Water Pollution Prevention Plan (SWPPP Improvements). <br /> <br />(11) Survey Monuments - Durable iron survey monuments shall be set, pursuant to <br />Minnesota Statutes, Section 505.02, Subd. 1, within one (1) year after recording of the final <br />plat of the Subdivision. Developer shall provide in writing notice to the City a Surveyor's <br />certification that all monuments have been set. <br /> <br />(12) Mailboxes, in a style and location approved by the City of Elk River, shall be <br />installed prior to a certificate of occupancy being issued for each lot within the Subdivisions. <br /> <br />3.)
