<br />Developer Agreement <br />Trott Brook Farms 12th <br />Page 9 <br /> <br />(05) Water Availability Charges - Purposely left blank <br /> <br />(06) Surface Water Management Fee - Developer shall pay surface water management <br />fees in the amount of Four Hundred Twenty Three and 25/100 dollars ($423.25), ($84.65 <br />per lot) for each lot in the Subdivision prior to release of the final plat for recording. <br /> <br />(07) Payment of Costs - Developer shall make timely payment of all amounts due under <br />this agreement, as summarized in EXHIBIT F, attached hereto. Tbis amount shall be paid <br />prior to execution and release of the final plat for recording, or within 30 days of invoicing <br />by the City. In the event that the developer sues the City and loses, the developer shall be <br />responsible for the City's legal costs relating to said suit. <br /> <br />(08) National Pollutant Discharge Elimination System Requirements - Prior to the <br />commencement of grading the Developer shall provide a signed Storm Water Pollution <br />Prevention Plan for City review and approval to control erosion from the site. Because the <br />site is over one (1) acre, the Developer shall also apply for and obtain an NPDES permit <br />from the Minnesota Pollution Control Agency. <br /> <br />(09) Street Construction - No street construction will be allowed after November 1 or <br />prior to May 15 unless approved by the City Engineer. <br /> <br />(10) Snowplowing - Until the Improvements are accepted by the City or the first lift of <br />blacktop is installed, the developer is responsible for snow removal and ensuring access by <br />Emergency Response equipment. <br /> <br />(11) Engineer Comments. The City Engineer's comments be incorporated into the <br />plans, attached as EXHIBIT G. <br /> <br />(12) History. Any item or condition found that indicates the site is likely to yield <br />information important to pre-history or history shall be reported to the city immediately, <br />and the city reserves the right in such event, to stop work immediately until the Subdivision <br />is appropriately investigated and developer is authorized to recommence work in writing. <br /> <br />.(U) FEMA approval. Final plat approval is conditioned upon an approval from FEMA <br />for the map amendment. No activity may be permitted and the Final Plat may not be signed <br />by the Mayor and Clerk until FEMA approval has been granted in writing. <br /> <br />(14) Construction Times. All construction activities shall be confined to the following <br />hours of operation: <br /> <br />Monday - Friday <br />Saturday <br />Sunday <br /> <br />7:00 AM until 8:00 PM <br />8:00 AM until 5:00 PM <br />Not Allowed <br /> <br />Tbis does not apply to activities that are required on a 24-hour basis such as <br />dewatering, etc. Any deviation from the above hours is subject to approval of the <br />City Council. <br /> <br />S:\PLANNING\Case Rles\2006\Plat\P 06-11 Trott Brook Farms 12th\Trott Brook 12 Development Agreement.DOC <br />
