RESOLUTION 06- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ADOPTING AND LEVYING ASSESSMENTS FOR UNPAID WATER UTILITY SERVICES AS OF SEPTEMBER I, 2006 WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, rvlinnesota Statutes Section 444.075 autllorizes tlle IVIurucipality to certify unpaid cllarges to cile COUllty allditor \\ricil taxes against cile property served for calleerio11 as otller taxes are collected; and, tile City's ordinance Section 78-191 autllorizes tlle J\1urucipality to lev)T an asseSSlnent against property for utilities collection equal to tlle unpaid cllarges for eaell year as of Septelnber 30; and, all custolners and property o\vners \Vitll delinquent balances as of September 1, 2006, 11a\Te been given adequate notice of dus pending asseSSlnent and lla-ve been giv'en opportunities to pay prior to tllls asseSSlnent being le\7ied; and, State la\v does not require a public l1earu1g or notice before lev-ying sucll asseSSlnents; and, Elk River NIunicipal Utilities COlllinission, on October 10, 2006, appro\Ted tlle proposed delinquent balances as of Septelnber 1, 2006 to be brougllt to tile City Council for appro~\'"-al of tile J\lunicipality to levy SUCll asseSSlnents.
