As you recall, this is the project <br />that crossed the Nord property to serve the development just west of County Road #1. In <br />that Feasibility Study, we anticipated trunk waterrnain being routed through the Meadowvale <br />Heights Development. In accordance with the City's assessment policy, we estimated the <br />lateral benefit from the trunk watennain to be $46,150.00. In actuality, as the Meadowvale <br />Heights Development proceeded, Dennis Backes constructed his internal improvements <br />himself, including that portion of trunk watermain we discussed in the Feasibility Study. In <br />fact, when the assessments were levied, Mr. Backes was given credit for the cost of the trunk <br />oversizing for that particular piece of watermain. However, we inadvertently continued to <br />assess the $46,150.00 for lateral benefit. This resulted in an assessment to Meadowvale <br />Heights Development for a piece of watermain that the Developer actually paid for. In <br />essence, if this assessment were to be paid, the Developer would pay for this piece of pipe <br />twice. <br /> <br />In order to rectify this situation, we are asking the City Council to officially rebate <br />$46,150.00 worth of assessments on the Meadowvale Heights Development for the trunk <br />sewer and water project.
